Acceptance of terms & eligibility
- By accessing, browsing, registering on, or using the Raizoh platform or any services made available through it, you agree to be legally bound by these Terms and the policies incorporated into them.
- You must be at least 18 years of age and legally competent to enter into a binding contract under applicable Indian law to create a fundraising campaign, make a contribution, receive funds, or otherwise use services that require contractual participation.
- By using the platform, you represent and warrant that the information you provide is accurate and complete; you will keep your account and information reasonably updated; you will not use the platform for any unlawful, fraudulent, misleading or prohibited purpose; and you will comply with applicable laws and all policies applicable to your use of the platform.
- If you use the platform on behalf of an organisation, you represent that you are authorised to act on its behalf and to accept these Terms on its behalf.
Nature of the platform & role of Raizoh
Raizoh operates as a technology-enabled online crowdfunding and social impact platform that facilitates digital interactions between voluntary contributors, campaign organisers, beneficiaries, healthcare institutions, NGOs, charitable organisations and other eligible participants. Raizoh provides technology and related platform services for campaign creation, discovery, communication, verification, payment facilitation, campaign management and related activities, subject to applicable law and the terms of relevant service providers.
To the extent applicable, Raizoh seeks to comply with the intermediary due-diligence and other requirements applicable to its platform activities under Indian law, including the Information Technology Act, 2000 and applicable rules made thereunder.
The creation, publication, promotion or support of a campaign through Raizoh does not create an agency, partnership, joint venture, fiduciary, trust, employment or other similar relationship between Raizoh and any campaign organiser, beneficiary, contributor, NGO, healthcare institution or other user, except where expressly agreed in writing.
Raizoh is a technology service provider and platform operator. Unless expressly stated otherwise, Raizoh:
- does not provide medical diagnosis, treatment, clinical advice or healthcare services;
- does not provide loans, investments, guaranteed returns or other financial products;
- is not itself a bank, lender, payment aggregator or other regulated financial institution;
- is not itself a charitable trust, NGO or charitable organisation; and
- does not guarantee the success, legitimacy, medical outcome or financial outcome of any individual campaign.
Payment processing and settlement services may be provided through appropriately authorised payment, banking or other service partners in accordance with applicable law.
Limitation of liability & absence of guarantee
Raizoh does not guarantee that any campaign will achieve its stated fundraising target, receive any particular level of contributions, or remain active for any particular period.
Campaign descriptions, medical information, diagnostic reports, treatment estimates, hospital documents, photographs, videos and other campaign materials are provided by campaign organisers, beneficiaries, healthcare institutions or other users. Raizoh may conduct verification or due diligence; however, verification does not constitute a medical opinion, diagnosis, certification, warranty or guarantee regarding the accuracy of medical information, treatment outcomes or quality of healthcare services. Raizoh is not responsible for medical treatment, clinical decisions, healthcare outcomes, or the acts or omissions of hospitals, doctors, healthcare providers, campaign organisers or beneficiaries.
Where funds have been successfully disbursed to a verified beneficiary, hospital, healthcare institution or other approved recipient in accordance with the applicable payout process, Raizoh is not responsible for the subsequent use or application of those funds by that recipient, except to the extent liability cannot lawfully be excluded. Campaign organisers and beneficiaries remain responsible for the truthful representation and lawful use of funds received by them.
Any verification, review, documentation check or communication conducted by Raizoh is intended to support platform safety and risk management. It should not be interpreted as an absolute guarantee that a campaign, organiser, beneficiary, medical claim, document, hospital estimate or intended use of funds is genuine or free from risk.
Raizoh reserves the right, subject to applicable law and its policies, to review, restrict, suspend, remove or disable access to campaigns, content, accounts or transactions where it reasonably believes that there is fraud, misrepresentation, misuse, policy violation, security risk, legal non-compliance or other material risk to users or the platform. Where legally required, Raizoh may also respond to notices, complaints, governmental directions or lawful requests from competent authorities.
Campaign creation, verification & user obligations
Campaign organisers and beneficiaries are responsible for ensuring that all information submitted to Raizoh is true, accurate, current, complete and not misleading, including identity information, beneficiary details, medical information and supporting documents, hospital information, treatment estimates, bank account details, fundraising purpose, photographs and videos, and any other information submitted in connection with a campaign.
Raizoh may request additional information or documentation before or after publication of a campaign and before or after payout, and may verify information with the campaign organiser, the beneficiary or authorised representative, treating hospitals or healthcare institutions, relevant organisations, payment or banking partners, or other appropriate sources.
Users must not:
- create or support fraudulent campaigns;
- impersonate another person or organisation;
- provide false, misleading or manipulated information;
- misuse funds;
- submit forged or altered documents;
- infringe intellectual-property or privacy rights;
- upload unlawful, defamatory, obscene or fraudulent content;
- use the platform for money laundering, terrorist financing, fraud or other unlawful activity; or
- use the platform for any purpose prohibited by applicable law or Raizoh's policies.
Campaign organisers are responsible for ensuring that they have the necessary rights, permissions and consents to submit and publish campaign content, including photographs, videos, medical information and other personal information relating to beneficiaries or third parties.
Contributions, tax treatment & fund payouts
Contributions made through Raizoh are voluntary. Subject to applicable law, payment-partner rules and the Refund Policy, contributions generally cannot be cancelled or refunded after funds have been successfully disbursed to the applicable verified recipient.
Contributions made to personal, individual-beneficiary or medical-emergency campaigns are generally not charitable donations eligible for a tax deduction merely because they are made through Raizoh. Unless applicable law specifically provides otherwise, Raizoh does not represent or guarantee that contributions to personal or medical crowdfunding campaigns qualify for a deduction under Section 80G of the Income-tax Act, 1961.
Where a campaign is conducted by an eligible charitable organisation, any tax deduction available to a contributor will depend on the legal and tax status of the relevant organisation, its eligibility under applicable law, the nature of the contribution, compliance with applicable tax requirements, and the contributor satisfying the applicable conditions. Where legally applicable, tax-deductible donation documentation, including Form 10BE, is the responsibility of the eligible charitable organisation conducting the campaign and is not issued by Raizoh unless Raizoh is legally entitled and required to issue such documentation. Contributors should independently verify the organisation's current eligibility and consult their own tax adviser before claiming any tax deduction.
Raizoh currently accepts contributions only through permitted domestic payment channels and does not facilitate foreign contributions or cross-border fundraising.
Where applicable, Raizoh may charge platform, technology, convenience, promotional or other permitted service fees, and any applicable taxes will be charged in accordance with prevailing law. Where a fee applies, the applicable amount or basis of calculation will be disclosed to the relevant user before or at the time of the applicable transaction.
Funds may be processed, settled and transferred through payment gateways, payment aggregators, banking partners or other authorised payment and settlement mechanisms, subject to applicable law and the terms of the relevant service providers, and may, where appropriate and operationally feasible, be transferred to a verified beneficiary, treating hospital, healthcare institution, NGO, charitable organisation or other approved recipient, subject to verification, campaign terms, payment-partner requirements and applicable law.
Refunds & cancellations
Contributions are generally non-refundable after successful disbursement to the applicable verified recipient, subject to applicable law, payment-partner rules and the Refund Policy, which sets out the circumstances in which a refund may be considered before disbursement, how to submit a refund request, and how refunds, cancellations, reversals and chargebacks are handled.
Intellectual property & indemnification
Unless otherwise stated, all rights, title and interest in the Raizoh platform and its underlying technology, software, source code, user interface, design elements, trademarks, logos, graphics, text, databases and other proprietary materials are owned by or licensed to Raizoh Ventures Private Limited and are protected by applicable intellectual-property laws. No user may reproduce, modify, distribute, commercially exploit or create derivative works from Raizoh's proprietary materials without prior written permission, except as permitted by law.
By submitting campaign content to Raizoh, you grant Raizoh a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, communicate, distribute and use such content as reasonably necessary to operate and administer the platform, publish and display the applicable campaign, facilitate fundraising, provide platform services, communicate campaign information, maintain records, promote Raizoh and its services, and improve the platform, subject to applicable privacy rights, intellectual-property rights and any required consent.
Medical documents, patient photographs, videos and other sensitive personal information will be handled in accordance with the Privacy Policy. Medical records and other documents submitted solely for verification will not ordinarily be publicly displayed. By submitting content, you represent that you have the necessary rights, permissions and consents to provide that content to Raizoh and to permit its use as contemplated by these Terms.
To the extent permitted by applicable law, users agree to indemnify and hold harmless Raizoh Ventures Private Limited, its directors, officers, employees and authorised representatives from claims, losses, liabilities, damages, costs and reasonable expenses arising from breach of these Terms, fraudulent, unlawful or misleading conduct, infringement of third-party rights, unauthorised use of personal information, misuse of campaign funds, or false or misleading campaign information submitted by the user.
Suspension & termination
Raizoh may suspend, restrict or terminate access to a campaign, account, feature or service where it reasonably believes that these Terms or applicable policies have been violated, fraud or misrepresentation has occurred or is reasonably suspected, unlawful activity is suspected, verification requirements have not been satisfied, there is a material security or financial risk, required information or documentation has not been provided, or such action is required by law, a competent authority or a payment/banking partner.
Where circumstances reasonably require immediate action to protect users, funds, personal data, the platform or legal compliance, Raizoh may take action without prior notice, subject to applicable law.
Termination or suspension of an account does not automatically extinguish obligations or rights that arose before termination, including obligations relating to payments, refunds, intellectual property, confidentiality, indemnification, disputes, compliance and record retention.
Governing law & jurisdiction
These Terms are governed by and construed in accordance with the laws of India. Subject to any mandatory rights or remedies available under applicable law, disputes arising out of or relating to these Terms or the use of the Raizoh platform shall be subject to the jurisdiction of the competent courts at Hyderabad, Telangana, India. Nothing in this clause prevents a user from exercising any statutory right or remedy that cannot lawfully be excluded or restricted by contract.
